Despite Washington law, it is still a federal crime to use, possess, manufacture, and distribute marijuana. The federal Controlled Substances Act classifies marijuana as a Schedule I drug. Complying with Washington's marijuana laws is not a defense against federal criminal charges.

With the passage of I-502, Washington State law enforcement has increased its patrolling and focus on trying to catch and charge more people for marijuana-related offenses than before the passage of the law.
The prosecution will likely use Drug Recognition Experts (DRE), toxicologists who will likely testify as to how marijuana affects your ability to drive, how you physically appeared to the police officer at the time of arrest (whether it's bloodshot eyes or slurred speech), as well as evidence of possession of some marijuana, as well as the presence of paraphernalia such as baggies, marijuana pipes, stash cans, etc.
The law in Washington State for drivers who have been driving after smoking or consuming marijuana is a blood concentration 5 ng/mL.
To be convicted of driving under the influence of marijuana, the prosecutor must show that blood results were at a concentration of 5 ng/mL of THC (marijuana's active ingredient) or higher or that you were affected by marijuana.
RCW 46.61.502 is the law that applies both to DUI and driving under the influence of marijuana. Part B of RCW 46.61.506 states that a person is guilty of driving while under the influence of marijuana when the person has, within two hours after driving, a THC concentration of 5.00 or higher as shown by analysis of the blood of the individual suspected of driving under the influence of marijuana.
A law enforcement officer has to get a blood draw from you within an hour of the stop for suspicion of driving under the influence because THC levels drop 50-80 Ng per ML to 5-6 Ng per MI in as little as an hour.
A person does have the legal right to refuse a blood draw, and if you do, then the law enforcement officer has to decide whether to obtain a search warrant for a blood draw.
However, if there has been vehicular assault or if there is what known as "exigent circumstances," the law enforcement officer can go ahead and get a blood draw from you even without a warrant.
It is important to note that it is not a defense to have a medical license to use marijuana for your particular medical condition.
If it's your first offense, it is considered a gross misdemeanor charge. Gross misdemeanors carry up to 24 hours to 364 days in jail, a fine ranging from $823.00 to $5000.00, a ninety (90) day license suspension, and five (5) years probation. Second and third offenses carry even more severe and punitive penalties.
Since 1998, a Compassionate Use Defense has been allowed under Washington State law. The law, always, continues to evolve and there are some encouraging signs on the State and National landscape.
However, one thing remains constant, a person can still be arrested and prosecuted for possessing cannabis.
This is the case, even if someone is an authorized patient with a prescription for the use of marijuana.
It is difficult enough that a person is suffering so badly that they must turn to a drug in order to seek relief.
It is far more difficult that a person must suffer the indignity and personal humiliation in front of family, friends and neighbors of a police raid.
